Surigao Del Norte Court Issues Warrant of Arrest for Yeng Constantino for ‘Cyber Libel’

The Regional Trial Court of Surigao Del Norte has issued a warrant of arrest for Yeng Constantino for a controversial post she shared in July 2019 about an incident that happened during a trip to Siargao with her husband, Yan Asuncion.

In a YouTube vlog, Yeng expressed her frustration over Dapa Siargao Hospital for allegedly not giving her husband immediate attention after he injured himself while cliff diving. She also complained about the medical equipment and lack of staff, among others.

She also uploaded the photo of the doctor, the OIC Chief of Hospital of Siargao District Hospital, Dr. Esterlina Tan, who she claimed had displayed a lack of concern and urgency over her husband’s injury.

But after facing backlash, Yeng took down all her posts related to the incident and issued an apology.

Dr. Tan has since filed a cyber libel complaint against the singer.

The order, issued December 12, 2019 and forwarded to the Quezon City Police chief, accuses Yeng of violating Sec 4 (c)(4) of Republic Act 10175 or the Cybercrime Prevention Act, which states “the unlawful or prohibited acts of libel as defined in Article 355 of the Revised Penal Code, as amended, committed through a computer system or any other similar means which may be devised in the future.”

Bail was set at PHP 30,000.

Yeng has yet to release a public statement regarding the warrant. According to a statement given by Yeng’s hired attorney, Atty. Joji Alonso, to PEP.ph, Yeng was allegedly unaware of Dr. Tan’s cyber libel complaint prior to the documents going viral online.

“Our services were engaged at past 4pm today, to assist Ms Yeng Constantino – Asuncion. Our client was not aware of any case filed against her, until her attention was called because of a social media post. We are now looking into the claim of cyber libel against her,” Atty. Alonso said.
